JobVolt — End User License Agreement (EULA)

This End User License Agreement ("EULA") is between you and Capionic LTD, a company registered in England and Wales with its registered office at 86-90 Paul Street, London, EC2A 4NE, United Kingdom ("Capionic LTD"), for the JobVolt mobile application (App Store name: "JobVolt: NEC Electrician Calc"), including all updates and accompanying documentation (the "Licensed Application"). It is entered into in addition to the Terms of Use. By downloading, installing, or using the Licensed Application, you agree to this EULA. If you do not agree, do not download, install, or use it.
1. Acknowledgement — this EULA is with the developer, not the store
1.1 You and Capionic LTD acknowledge that this EULA is concluded between you and Capionic LTD only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). Capionic LTD, not Apple or Google, is solely responsible for the Licensed Application and its content.
1.2 This EULA does not grant rights inconsistent with the App Store Terms of Service or the Google Play Terms of Service. Where this EULA is more restrictive than the applicable store's terms, the store's terms govern to the extent of the conflict.
2. Scope of licence
2.1 Capionic LTD grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to use the Licensed Application: (a) on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (including access by other accounts associated with you via Family Sharing or volume purchasing, where enabled); and/or (b) on any Android device you own or control, as permitted by the Google Play Terms of Service; in each case for your own professional or personal use and not for onward distribution.
2.2 Except as this EULA and the store's Usage Rules allow, you may not make the Licensed Application available over a network where it could be used by multiple devices at once; or rent, lease, lend, sell, redistribute, or sublicense it (except a permitted backup copy).
2.3 Restrictions. You may not reverse engineer, decompile, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, except to the extent that restriction is prohibited by applicable law or permitted by the licence terms of any open-source components included in it. You may not remove or alter proprietary notices.
2.4 Reservation. All rights not expressly granted are reserved by Capionic LTD and its licensors. The Licensed Application is licensed, not sold.
2.5 Availability and intended jurisdictions. The Licensed Application is built for the National Electrical Code (NFPA 70) and NEC-derived electrical codes, and calculates against the 2023 or 2026 NEC editions. It is offered only in NEC / NEC-derived jurisdictions: the United States (including Puerto Rico), Mexico, Colombia, Costa Rica, Panama, the Dominican Republic, Guatemala, El Salvador, Honduras, Nicaragua, Ecuador, Peru, Bolivia, Venezuela, and the Philippines. It is deliberately not offered in, and is not intended for use in, the United Kingdom, the European Union/EEA, Canada, or Australia and New Zealand, which apply different electrical standards (for example BS 7671, the Canadian Electrical Code, and AS/NZS 3000). The Licensed Application is a calculation aid only and is not a substitute for the applicable code, the authority having jurisdiction, or a qualified professional's own verification (see Terms of Use).
2.6 Language. The Licensed Application's user interface is available in English and Spanish. PDF reports and NEC code terms are provided in English, the language electrical inspections expect.
2.7 Free and Pro features. The Licensed Application is offered on a free tier and a paid "Pro" subscription. The free tier includes 5 calculators, 1 report containing up to 6 blocks, and the Submittal template. Pro unlocks Load Calc, Motor, and Grounding, unlimited reports and blocks, all six templates, and the company logo on the report letterhead. Subscription prices, any free trial, and any one-time "Lifetime" purchase are shown in the store at the point of purchase, which is authoritative; indicative prices (for example US and Puerto Rico at $6.99/month, $39.99/year with a 7-day free trial, and Lifetime at $79.99, and lower prices on Latin American and Philippine storefronts) may vary by storefront, currency, and time. Purchases and renewals are processed and billed by Apple or Google under their terms.
3. Consent to use of data
3.1 The Licensed Application processes data as described in the Terms of Use and the Privacy Policy at jobvolt.app/privacy. In summary: your reports, calculations, and Company Profile are stored locally on your device; there is no provider-operated server for your content; and limited technical data is processed by RevenueCat (subscriptions), Sentry (crash reports, production only), PostHog (analytics), and Apple/Google (payments), each only where enabled in the release build, and each also receiving your IP address. Apple and Google are not responsible for this processing.
3.2 Data protection and your rights. Capionic LTD is established in the United Kingdom and acts as the data controller for this processing. UK data protection law (the UK GDPR and the Data Protection Act 2018) governs that processing, and the rights it gives — including access, correction, deletion, objection, restriction, and portability — are extended to all users regardless of where they are located. Because the Licensed Application is offered in the United States (including Puerto Rico), the Latin American countries listed in clause 2.5, and the Philippines, Capionic LTD also honors the privacy rights that applicable local data-protection law gives you where it applies — for example Mexico's Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP) and its "aviso de privacidad" requirements, comparable laws in other listed countries, and the California Consumer Privacy Act as amended by the CPRA — in addition to the rights above. 4. Maintenance and support
4.1 Capionic LTD is solely responsible for any maintenance and support for the Licensed Application. Apple and Google have no obligation whatsoever to furnish maintenance or support services.

5. Warranty
5.1 The Licensed Application is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, to the fullest extent permitted by law, as set out in the Terms of Use, clause 9, which applies here.
5.2 Apple warranty refund (iOS). In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application. As between Apple and Capionic LTD, any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of Capionic LTD.
5.3 To the extent any warranty cannot be disclaimed under applicable law (including mandatory consumer rights), it is limited in duration and scope to the minimum permitted by that law.
6. Product claims
6.1 As between Capionic LTD, Apple, and Google, Capionic LTD, not Apple or Google, is responsible for addressing any claims by you or a third party relating to the Licensed Application or your possession/use of it, including: (a) product liability claims; (b) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (c) claims under consumer-protection, privacy, or similar laws, including in connection with any in-app subscription or purchase framework.
6.2 This EULA does not limit Capionic LTD's liability beyond what applicable law permits (see Terms of Use, clause 10, including the non-excludable carve-outs for death/personal injury caused by negligence, fraud, and the Consumer Protection Act 1987).
7. Intellectual property
7.1 The Licensed Application and all intellectual property in it are owned by Capionic LTD and its licensors. In the event of a third-party claim that the Licensed Application or your possession/use of it infringes that third party's intellectual property rights, Capionic LTD, not Apple or Google, is solely responsible for the investigation, defense, settlement, and discharge of the claim, to the extent required by this EULA and applicable law.
7.2 NEC® and National Electrical Code® are registered trademarks of the NFPA; JobVolt is not affiliated with or endorsed by the NFPA (see Terms of Use, clause 6.3).
8. Legal compliance and export
8.1 You represent and warrant that: (a) you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country; and (b) you are not on any US Government list of prohibited or restricted parties.
8.2 You will comply with all applicable US and other export-control and sanctions laws and will not use or export the Licensed Application in violation of those laws.
9. Third-party terms and beneficiaries
9.1 You will comply with applicable third-party terms when using the Licensed Application (for example, your wireless data-service agreement).
9.2 Apple and Google as third-party beneficiaries. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and that, upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary. Google and its affiliates are likewise third-party beneficiaries with the equivalent right to enforce this EULA against you regarding the Licensed Application obtained through Google Play.
10. Term, governing law, and contact
10.1 This EULA is effective until terminated by you or Capionic LTD. Your rights terminate automatically if you fail to comply with any term. On termination you must stop all use and delete all copies.
10.2 This EULA is governed by the laws of England and Wales, subject to the preservation of mandatory local consumer rights in the Terms of Use, clause 12.3.
